Law Enforcement Assistance Application Guidelines

The following guidelines apply to law enforcement officers requesting Freechat account records. This information is subject to change at any time.

Requesting User Information

We will only disclose account records in accordance with our Terms of Service and applicable laws, including the federal Stored Communications Act (SCA), 18 U.S.C. Sections 2701-2712. Under the SCA:

  • A valid subpoena signed by a law enforcement agency conducting a formal criminal investigation is required to compel the disclosure of basic subscriber records (as specified in 18 U.S.C. Section 2703(c)(2)). Basic subscriber records may include: name, length of service, credit card information, cryptocurrency wallet address, email address, and any recent login/logout IP addresses (if available).

  • A court order issued under 18 U.S.C. Section 2703(d) is required to compel the disclosure of specific records or other information from an account (excluding content of communications). This includes message headers, IP addresses, and the aforementioned basic subscriber records.

  • A search warrant issued under the procedures described in the Federal Rules of Criminal Procedure, or equivalent state warrant procedures, is required to compel the disclosure of the stored contents of any account. This may include messages, photos, comments, and location information.

Please note that some of the information we store is automatically collected, while other information is provided by users. We do not require email or phone verification, nor do we require users to use their real name or identity on Freechat. Data Retention and Availability

We retain different types of information for varying periods. Due to the volume of real-time content on Freechat, some information may only be stored for a short time. We do not preserve data for law enforcement purposes unless we receive a valid preservation request.

Required Information

When making a request, detailed information must be provided, including the specific data category being requested and the date range of the request. Additionally, the following must be included:

  • The name of the issuing agency and agent, an email address within the law enforcement domain, and a direct contact phone number.

  • The Freechat account username associated with the relevant dates, along with details on the specific information requested and its relevance to the investigation. Account usernames frequently change, so we cannot process requests without the relevant dates and corresponding usernames.

Emergency Requests

For matters involving immediate threats of death or serious bodily injury, including those involving the potential harm of a child, law enforcement officers may submit requests through our online law enforcement request system. Important Note: We do not review or respond to messages sent to this email by non-law enforcement personnel. In an emergency, individuals should immediately contact local law enforcement.

Child Safety

We report all apparent child sexual exploitation cases displayed on our platform to the National Center for Missing and Exploited Children (NCMEC) as required by applicable laws, including those cases brought to our attention by government requests. NCMEC will refer the matter to law enforcement agencies worldwide to help victims. If your request involves child exploitation or safety issues, please indicate this in your request (and include relevant NCMEC report identification information) to ensure we can address these matters swiftly and effectively.

We only disclose account information following applicable Terms of Service and applicable laws. A mutual legal assistance treaty request or letter rogatory may be required to compel the disclosure of account content. For more information, please refer to our Privacy Policy.

Account Preservation

Upon receiving formal legal process notification, we will take steps to preserve account records related to official criminal investigations for 180 days. You may submit a formal preservation request promptly through our online law enforcement request system, by email, or by mailing a letter to the address below.

User Authorization

If law enforcement seeks information about a Freechat user and the user has consented to law enforcement access or obtaining their account information, the user should be instructed to retrieve this information from their account. Users can access their account content, such as messages, photos, and videos, via the “Download Data” feature in the “Privacy & Security” settings of their Freechat account.

Notice

Our policy is to notify users of requests for their information before disclosure, except where legally prohibited or in exceptional circumstances such as child exploitation cases, emergencies, or where notice would be counterproductive. We will provide delayed notice when a court order specifies a confidentiality period, when we believe there are no longer exceptional circumstances, and when the law no longer prohibits us from providing notice. If the notice is believed to hinder an investigation, law enforcement should obtain the appropriate court order or other documentation proving that pre-notification is prohibited. If your data request brings to our attention that a user is repeatedly violating Freechat's Terms of Service, we may take action to prevent further violations, and such action may alert the user that we are aware of their activity.

Testimony

We do not provide expert testimony. All records produced are self-authenticating and do not require the testimony of a records custodian. If special certification is required, please include the relevant documents with your records request.

Cost Reimbursement

We may seek reimbursement for costs incurred in responding to information requests as permitted by law. Additional fees may be charged for special or complex requests. We may waive fees for matters involving potential harm to children, Freechat, or Freechat users, as well as emergencies.

Submitting Requests

Online: Law enforcement officers may submit, track, and process requests through our online law enforcement request system. Access to the online system requires an email address issued by a government agency.
