What information do you need to provide to Freechat?

When registering for a Freechat account, we will need your email address and nickname. You can use the additional information to further optimize and populate your profile. If you use some of the features available within Freechat (e.g., posting photos to your friends), we will process your information to provide these features.

How do we use your information?

We use your information to provide you with the Freechat service, to allow you to communicate with other users, to give you access to the features available on Freechat, and to improve and support your Freechat experience. If you are a parent or guardian of a child and have given them permission to use Freechat, we will retain the contact information you provide to ensure that we can verify any requests or questions you may have about your child's Freechat account.

Who do we share your data with?

We do not share your information with third parties except as necessary to provide services such as text messaging, location, and mapping service providers, or as directed by a court, appropriate authority or as required by law. We only use these third-party services to process or store your information for the purposes described in this Privacy Policy. Any third party with whom we share user data is required to provide the same or equivalent protection of user data as described in this Privacy Policy.

Where do we process your data?

Below is a summary of the information contained in this Privacy Policy ("Hong Kong SAR"). We also have support, engineering, and other teams that support the delivery of Freechat services to users around the world who will have access to your information. We have strict internal controls in place to limit access to your data to designated personnel only.

How long will we keep your information?

How long we retain your information depends on the type of information, for example, login data is retained for up to 7 days from the date the data is collected. We will retain your information for no longer than required by law.

How can you exercise your rights over your data?

Depending on where you live, you may have special rights over your data and how we use it. These include how to access data, delete data, restrict how data can be used, object to data use, and obtain a copy of your information.

1. Introduction

Welcome to Freechat!

When you use the Freechat mobile application, desktop application, or website www.freechat.world (collectively, "Freechat"), we will collect certain personal information (as defined below) from you.

This Privacy Policy explains when, how, and why your personal information relating to Freechat is processed and sets out your choices and rights in relation to that personal information.

For the purposes of this Privacy Policy, "we" or "us" or "our" refers to

Unless otherwise defined in this Privacy Policy, any capitalized terms used in this Privacy Policy shall have the same meaning as the equivalent terms in the Freechat Service Agreement.

By using Freechat, you consent to the processing of your personal information in accordance with this Privacy Policy. If you do not consent to the processing of your personal information in the manner described in this Privacy Policy, please do not provide your personal information to Freechat upon request and stop using Freechat.

2. Scope and application

This Privacy Policy applies only to Freechat users.

This Privacy Policy does not apply to functions operated by Freechat, Freechat open platform services, including Mini Programs, Freechat Login, Freechat Pay, that you may use the Freechat platform (such as Scroll, Audio, News, etc.), or Personal information collected by third-party services accessed through third-party websites viewed through your internet browser) and personal information you choose to share with Freechat users. Please refer to the privacy policy of the relevant third-party service.

If you use Freechat on behalf of a company, partnership, association, government or other organization ("Organization"), you agree to notify such persons in your organization ("Related Persons") whose personal information we collect or which you provide to us their personal information (as defined below), and you agree to obtain their consent for us to process their personal information in accordance with this Privacy Policy as required by applicable laws and regulations. When this Privacy Policy refers to "you" or "your", this includes you and any relevant persons. If you or anyone involved wishes to request that your personal information be removed from our database, please contact us at hello@freechat.world.

3. Definition

"Location Data" is information derived from your GPS (GPS coordinates), WiFi (approximate city location), IP address (country location), or public posts containing location information (your geotagged location). Location data will be disclosed (to us, other users, or both) when:

· When using location-based features and when you share your location with other Freechat and/or Freechat users; and

· When visiting Freechat, we automatically obtain location data from your IP address, device, or internet service for security purposes, including preventing suspicious logins and account theft.

You can disable the collection and use of your location data through device-level settings.

"Log Data" is the information we automatically collect when you use Freechat, including:

· Device properties, such as your mobile operator and network-related information), your device version and resettable identifiers, configuration information provided by your Freechat mobile app or desktop or web browser, and your IP address;

· Information about your viewing history on Freechat, such as social media profiles visited and details of other content you have accessed or requested;

general information about communications on Freechat, such as the users with whom you communicate and the time, dat,e and duration of the communications (but not the content of such communications), statistics about your Freechat usage, and traffic data; and

· Metadata, which is information about your project that you provide through Freechat, such as the date, time, or location when a shared photo or video was taken or published.

"Personal Information" is any information or combination of information that we process in connection with your use of Freechat, that relates to you and that can be used (directly or indirectly) to identify you.

"Shared Information" is information that you include in your publicly visible Freechat profile, the information you provide to other users through Freechat (such as through your Moments and Status posts), the information provided by another user through the use of Freechat or Freechat your information, and location data.

4. How do we use your information?

This section details the types of personal information we collect from you, the purposes of the processing, and the retention periods for each type of personal information.

In the case of users residing in the relevant jurisdiction, the legal basis on which we process your data is also indicated. For the purposes of this Privacy Policy, "Relevant Jurisdictions" include the EEA, United Kingdom, Switzerland, Brazil, Thailand, and Turkey.

We will not retain personal information for longer than required unless required by applicable law. For more details on how we store your data, please see the retention periods below. If we are required to retain your personal information beyond the retention period described below, for example, to comply with applicable laws, we will store it separately from other types of personal information. Aggregated registration data (without personal information) will be retained for spam prevention and system security purposes.

Registration data and login data. Your nickname, IP address, email address used to register your Freechat account. Legal basis (relevant jurisdictions only): Necessary for the performance of our contract with you to create your Freechat profile and provide Freechat services.

Registration data will be retained until your account is deleted. Login data will be retained for 3 months from the date of login.

Shared Information - Profile Data. Any information contained in your publicly visible Freechat profile, which may include your Freechat ID, first name, gender, region and photo. Legal Basis (Relevant Jurisdictions Only): Necessary for the performance of our contract with you to provide your Freechat Personal Data and Freechat Services.

- Allow your profile data to be shared with other Freechat users; - Allow you to log in with your Freechat ID or otherwise connect to third-party services; - Help you use Freechat features; - Provide you with personalized user support; - Provide language and location customization; - Develop new services and improve the experience of existing services and applications; - Maintain and manage the Freechat platform; and - For troubleshooting, data analysis, testing, research, security, fraud detection, and account management.

Until you request the removal of your shared information or your account is deleted, whichever is earlier (however, data may be stored on third-party services and retained in accordance with their respective privacy policies).

Shared Information - Personal Profile Media. This includes all information that you provide to other users or that other Freechat users provide about you, including friend and status posts. Legal basis (in the relevant jurisdiction only): Necessary for the performance of our contract with you to provide your Freechat personal data and Freechat services.

Additional account security information (if you choose to protect your account). Email address. Legal Basis (Relevant Jurisdictions Only): Necessary for the performance of our contract with you to provide and protect your Freechat account.

chat data. Content of communications between you and another user or group of users. We do not keep chat data permanently on our servers, but simply transmit this information through our servers so that it can be distributed to the intended recipients of your chat data. Chat data is only stored on your device and on the devices of the users to whom you have sent communications unless the recipient stores any of your communications to their favorites or the administrator of the group chat adds group announcements. Legal Basis (Relevant Jurisdictions Only): Necessary for the performance of our contract with you to provide Freechat chat services.

Chat messages are automatically and permanently deleted as soon as they are sent to the recipient's device, and in any case, 72 hours after you send them. Chat media such as pictures, audio, video, and files are automatically and permanently deleted from our servers 120 hours after you send them.

log data. See the definition above. Legal Basis (Relevant Jurisdictions Only): It is in our legitimate interest to secure our services, manage registration and improve our services.

location data. See the definition above. Legal Basis (Relevant Jurisdictions Only): Necessary for the performance of our contract with you to provide Freechat location-based services. Please note that if you use location-based services, you are subject to the terms of use and privacy policies of the third-party service providers for location-based services that support such services, such as Foursquare.

- Facilitates your use of location-based services, such as: - Using your GPS and then sharing your real-time location via chat; - Manually geo-tagging locations in Moments or status posts; - GPS-dependent nearby people; - For security, fraud detection, and account management; and - Provides language and location customization.

Location data for location-based services: - Location data shared via chat is permanently deleted 72 hours after you share it. - Moments and Status: Retained until you delete the post, or your account is deleted, whichever comes first. - People nearby and Shake: Permanently delete 1 hour after you quit this feature. Location data used for all other purposes will be retained for 3 months from the date of collection.

Payment Card Information - Parent/Guardian Consent. In order to comply with child protection laws, payment card information from parents/guardians is collected to verify that children attempt to create a Freechat account with parent/guardian consent and payment card information is verified by a third-party payment processing service. Freechat only retains the verification date and hashed payment card number after a third-party payment processing service performs a verification request. Legal basis (relevant jurisdictions only): We process this data in accordance with our obligations under applicable law.

To verify that the child has parent/guardian consent when attempting to create a Freechat account.

Until a parent/guardian or user requests the removal of payment card information, and only if the user has reached the age of majority under applicable local law.

Customer Support Information. Communications and any information you or other users have with our customer support team. Legal Basis (Relevant Jurisdictions Only): Necessary for the performance of our contract with you to provide and support Freechat.

- to investigate issues and provide customized customer support; - to develop new services and improve the experience of existing services and applications; and - for security, fraud detection, and account management.

Interface credentials. Interface credentials are used to easily link your Freechat account with your third-party social media accounts. Legal Basis (Relevant Jurisdictions Only): Necessary for the performance of our contract with you to provide Freechat services.

If you connect a third-party social media account to your Freechat account, we process interface credentials to allow you to log in and share content between those accounts.

Until you unlink your Freechat account from these third-party social media accounts.

Surveys. If you participate in a survey, we may ask you to provide certain personal information. The purpose of the survey and the identity of the service provider providing the survey (if we have hired one) will be communicated to you before you complete the survey. Legal basis (relevant jurisdiction only): We require your consent to collect this information.

- To better understand how you access and use Freechat; - To develop new services and improve the experience of existing services and applications; - To improve Freechat and to respond to customer requests and preferences; and - For any of the purposes described in the survey.

Until your account is deleted or otherwise specified in the investigation, whichever is earlier.

Marketing Preferences. You wish to receive or not receive marketing communications (including personalised advertising) Legal basis (relevant jurisdictions only): Consent.

Make sure we provide marketing services based on your preferences.

Be informed of your interests by your behavior in the app. This only applies to users located in jurisdictions where personalized ads can be served in the moments

We may also pseudonymize or aggregate personal information for analytical purposes. This helps us to develop new services and improve existing services, perform fraud detection and account security analysis, analyze usage trends, and provide third-party service providers with basic statistics on how Freechat users use its services.Sensitive Personal Information

In some jurisdictions, certain types of personal information (such as information about your race, religion, political or philosophical views, sexual orientation, and health status) may be considered "sensitive information" and are subject to more stringent regulation than other types of personal information.

Freechat will not ask you to provide sensitive personal information in order to use the Services. By posting or transmitting any sensitive personal information in Freechat, you agree that such information may be provided within the privacy controls you have chosen.

Sharing Information

You can control what shared information is disclosed to other Freechat users through the privacy settings in Freechat. After you delete shared information, it may still be cached, copied or stored separately or remain public by other users or third parties who are not affiliated with us and are not under our control. Please consider carefully what you post and communicate through Freechat.

Personal Information in Your Content

If any of your personal information contains Your Content (as defined in the Freechat Service Agreement), we may (subject to this Privacy Policy) use such personal information in accordance with the "Your Content" section of the Freechat Service Agreement. We will process Your Content to ensure compliance with Freechat's Service Agreement and Acceptable Use Terms.

5. Who do we share your data with?

We will not transfer your personal information to third parties unless otherwise specified below or you consent to us doing so.

We only share your information with selected recipients as reasonably necessary, including:

· Service provider. We employ service providers to provide services to support and improve Freechat. These include SMS, VOIP, payment card processing and verification, translation, location and maps, customer service, and content delivery service providers. These service providers are required to provide the same or equivalent protection of user data as described in this Privacy Policy and are prohibited from retaining, using or disclosing your information except as necessary to provide services to us;

· Third Party Services. When you:

o Log in to Freechat using a third-party authentication service;

o sharing content from Freechat to third-party services;

o sharing content to Freechat from third-party services;

o access content from Freechat third party services that are not Freechat; or

Link your Freechat contact list to your list on third-party services from which we may receive information about you and/or share your information with such third party services. Third-party services may collect information (including personal information and log data) and set cookies on your device. This Privacy Policy applies only to information collected by us and not to information collected by third parties.

If available in your jurisdiction, you can access Freechat Pay through the Freechat platform. Due to regulatory requirements, when you use any Freechat Pay and/or its affiliates’ payment services, your information may be collected, retain, share and/or store. We will also share your information with these entities to the extent necessary to facilitate your use of these services. By following the instructions listed, you can control which third parties have access to your information and withdraw your consent to the sharing of your information. Please note that if you ask us not to share your information with certain third parties, you may no longer be able to use thosethird-partyy services;

Advertising partners. We may share reports on trends and their ad performance with advertising partners to help them better understand their audiences. We will not share your personally identifiable information, such as name or email address unless you allow us to do so;

· Third parties or related group companies, in the event of a merger, acquisition, reorganization, or sale of assets, or for legal or other reasons, we will transfer your information to such entities in order to continue to provide you with services. In these cases, we will always require third parties or relevant group companies to comply with this Privacy Policy;

· Government, public sector, regulatory, judicial, and law enforcement agencies or authorities. We are legally required to disclose your information in certain circumstances, including (i) to comply with legal obligations or requests, such as court orders, subpoenas, or other legal processes, (ii) to enforce our terms, (iii) to process and security or Fraud-related matters, or (iv) emergencies involving death, risk of serious personal injury, or any risk of harm to children, provided that the entity requesting the information has effective jurisdiction to obtain your personal information. Access to our Law Enforcement Data Request Guidelines;

· Third parties upon your request, for example, upon your data migration request.

6. Where do we process your data?

Freechat is a social global platform. Our engineering, technical and other support teams are in our FreechatDAO organizations around the world, and these teams may sometimes have access to your information.

7. Security of Personal Information

We are committed to maintaining the privacy and integrity of your personal information, regardless of where it is stored or accessed. We protect your personal information by adopting information security and access policies that restrict unauthorized access to our systems; implementing technical safeguards for your personal information during data transmission and storage to ensure the confidentiality of the information, such as encryption measures.

We do not permanently retain chat data between you and other users on our servers. We only transmit chat data through our servers so that it can be securely distributed to the intended recipient. Chat data is stored only on your device and on the devices of users to whom you have sent communications, except to the extent that the recipient stores any of your communications in their favorites or the group chat owner or administrator add the message as a group announcement.

Although we will implement and maintain reasonable measures to protect your personal information, please note that any transmission of information over the Internet is never completely secure.

8. Advertising

You can opt out of receiving personalized advertising from us by following the opt-out instructions in the Freechat Settings section; you can also contact us at hello@freechat.world.

9. Communications from us

When necessary, such as when we suspend Freechat for maintenance, security, or privacy reasons, we may send you service-related announcements via Freechat, email, or text message. These service-related announcements are not advertising in nature, and you cannot opt out of receiving them.

10. Age Restrictions and Parental/Guardian Controls

Children under the age of 16 (or the age of majority under the relevant local laws of the user) ("Children"), without the prior consent of a parent/guardian and confirmation of this Privacy Policy (whether for themselves or on behalf of their children), shall not Use Freechat for any purpose. In some jurisdictions, you may be asked to provide your date of birth; this information is only processed on your device and not sent to our servers. We do not knowingly collect personal information from any child without the above consent and confirmation. If you believe that we hold any personal information of any child without parental/guardian consent and confirmation, please contact our Data Protection Officer so that we can investigate and delete such personal information immediately.

11. Your rights

This Section 10 (Your Rights) applies only to users located in the relevant jurisdiction unless otherwise specified.

If you are a user located in the following countries: Australia, Brazil, California, Canada, Hong Kong SAR, India, Indonesia, Japan, Macau SAR, Malaysia, Mexico, Philippines, Russia, Serbia, Singapore, South Korea, Sri Lanka, Taiwan, Thailand, Turkey, United Arab Emirates, United Kingdom and Vietnam, the terms listed under your jurisdiction apply to you in addition to the terms set forth in our Privacy Policy.

Please note that to protect your information, we will need to verify your identity before responding to any rights exercise request ("DSR Request").

For users in the relevant jurisdictions, we will respond to your DSR request immediately, without undue delay, and in any case, within one month (but in certain circumstances, such as when the request involves a large amount of information or complex circumstances, can be extended for another two months).

Right of Access and Correction

This section also applies to users residing in Argentina, Canada, India, and Russia.

You have the right to request access to the personal information we hold about you, how we use it and with whom we share it. We may not be able to provide you with certain personal information if providing you certain personal information would interfere with the rights of others (for example, if providing personal information we hold about you would reveal information about another person).

You also have the right to correct inaccurate or incomplete information.

You can access and correct your personal information at any time by logging into your Freechat account. For example, you can delete some location data through the device settings or the "Clear Location" option in Freechat.

If we agree to correct your personal information, we will take reasonable steps to inform any third parties to whom we have disclosed relevant personal information so that they can also correct that personal information.

Delete

This section also applies to users residing in Argentina, Canada, India, and Russia.

You can log in to your Freechat account and follow the Freechat account deletion instructions to delete your account or remove certain personal information. After an account deletion, your data will be completely untouched.

Please note that we will not be able to delete your account if you have a positive balance in your Freechat Pay or Freechat Pay account, or if you are the administrator or developer of a creation number or applet.

You may request that we erase the personal information we hold about you if

- You believe that we no longer need to hold your personal information.

- we have obtained your consent to process your personal information and you withdraw that consent (and we have no other valid and lawful reason to process the personal information)

- you believe that we are processing your personal information unlawfully; or

- you are under the age of 16 (or the age of majority under relevant local law) at the time we collect the personal information, and we can verify this.

You may exercise your right to restrict our processing of your personal information while we are considering your data erasure request (as described below).

We may retain personal information if we have a good legal basis to do so (for example, for the defense of legal claims, freedom of speech, or other legal obligations), but we will notify you if this is the case.

If you have requested us to delete personal information that you have set to be publicly available and there is a legitimate reason for such deletion, we will take reasonable steps to inform any third party to whom we have disclosed the personal information in question so that they may also delete that information.

Processing is limited to storage

This section also applies to users who reside in Russia.

In some cases, you have the right to request that we stop processing your personal information and only store such information. However, we may process your personal information if we have a legitimate reason to do so (for example, to defend a legitimate claim or to protect others).

If we agree to stop processing personal information, we will take reasonable steps to inform any third party to whom we have disclosed the relevant personal information so that they can also stop processing it.

You may request that we stop processing the personal information we hold about you and only store it if

- you believe that the personal information is inaccurate (for the period of time it takes to verify its accuracy)

- we wish to erase the personal information because the processing is now unlawful (but you want us to retain the personal information in stored form only); or

- we wish to erase personal information because we no longer need it (but you request that it be stored for the purpose of establishing, exercising, or defending a legitimate claim).

Portability

You have the right to obtain a copy of certain personal information about you in a structured, common, and machine-readable format. This includes any personal information that we process based on your consent (for example, shared information or the contents of a collection) or any personal information that we process under a contract with you (for example, profile data).

You also have the right to request that we transfer this personal information to another party. If you would like us to transfer personal information to a third party, please ensure that you provide details of such a third party. Please note that we will only make such transfers where it is technically feasible to do so. Once such a third party has received the personal information, we will no longer be responsible for its security or its processing.

Right of refusal

This section also applies to users who reside in Russia.

If we use your personal information to protect our legitimate interests (for example, if we use your personal information to ensure the security of your account), you may refuse our use of your personal information.

12. Changes to this Privacy Policy

We may revise this Privacy Policy from time to time. We will update the revised version and the "last updated" date here and notify you via Freechat or other means, as applicable, before the changes become effective.

13. Language

We have provided a translation of this Privacy Policy, but in the event of any conflict between the local language version and the English version, the English version shall prevail, unless otherwise required by applicable law.

Overseas Recipients

We take reasonable steps to ensure that third parties located outside of Australia who receive your personal information process it in a manner consistent with Australian privacy laws. However, you acknowledge that we have no control over, and are not responsible for, the actions and omissions of such third-party recipients.

Access Rights

You have the right to access the personal information we hold about you, how we use that information and with whom we share it. You can access the personal information you have provided for your account by logging into your account. Right of Correction

You have the right to correct any personal information we hold about you that is inaccurate. You can access the personal information we hold about you by logging into your Freechat account. If you believe that we hold any other personal information about you and that it is inaccurate, please contact us at hello@freechat.

Children

If you are under the age of 18, you undertake to obtain the consent of your parent or legal guardian to register an account on the Service and use Freechat.

Brazil

This section applies to users located in Brazil.

Withdrawal of Consent

Whenever we use your personal information in accordance with your consent, you may, subject to contractual or legal restrictions, withdraw your previously granted consent to the collection, use and disclosure of personal information. To withdraw this consent, you may terminate your Freechat account, or contact hello@freechat. this may prevent us from providing Freechat to you.

Parental and Guardian Consent

- Biometric information, such as voice print. Such information collected directly from consumers or devices.

- Business information, including payment card information and transaction verification information. Such information is collected directly from the consumer or device.

- Audio, electronic, visual or similar information, including profile pictures. Such information is collected directly from the consumer; and

- Other information as described in Section 1798.80, subpart (e), such as nationality and gender (this information is collected in the context of the consumer, not the employer). This information is collected directly from the consumer.

We collect personal information for the following purposes:

- Operating and administering Freechat.

- Communicating with consumers.

- To improve our services.

- For security and verification purposes, including the prevention and detection of fraudulent activity; and

- To address and remedy technical problems and procedural errors.

We may disclose the types of personal information identified in this Privacy Policy to the following types of entities:

- Partners associated with Freechat who process your personal information for the purpose of operating the service.

Sensitive Personal Information

"Sensitive Personal Information" means passwords, financial information (such as details of bank accounts, credit cards, debit cards or other payment instructions), biometric data, data relating to physical or mental health, sex life or sexual orientation, and/or medical records or medical history and similar data, but does not include data that is available in the public domain or under the provisions of Indian law, including the Right to Information Act, 2005.
